Terms and conditions
In these booking conditions, ‘we’ means P & G Durbin T/as Cottage Escapes. When you make a booking with ‘Cottage Escapes’, you are entering into a contract with us the owner of the properties. Any booking made for a property in the Lake district will be adhering to the terms and conditions of our agent ( Cumbrian Cottages ) in that region. Any booking made on the Whitby flat ‘Keldergat’ will be adhering to the terms and conditions of our agent ( Yorkshire Cottages).
Before making a booking, please read our terms and conditions carefully and you agree that your booking is for the sole purpose of holiday accommodation with no rights to the property other than occupation during the term of your holiday.
The person making the booking must be over 18 at the time of booking and as party leader must be authorised by other members of your party to place the booking, all persons accept they are subject to the terms and conditions of booking.
Making a booking
Bookings are accepted either by telephone or through our websites, we will issue a written confirmation of booking once the 25% deposit has been received. The confirmation will normally be sent by email or letter depending which method you request. it is important that you check the details on the booking confirmation to ensure it is all correct and advise us of any necessary amendments immediately.
If we have grounds to believe a booking is not legitimate or would breach our booking conditions, we may cancel the booking and advise you in writing with no legal responsibility to you.
We charge a non refundable deposit payment of 25% of the total holiday value, we only accept payment in £’s and either by credit card, debit card, bank transfer or cheque. The remaining balance payment is due 6 weeks before the arrival date. If you book within 6 weeks of your arrival date, the full amount of payment is due when you place the booking. For any bookings made within two weeks of arrival all forms of payment are acceptable except by cheque.
If you do not pay your final balance payment by the due date, we will assume you do not want the booking and cancellation charges will apply per conditions below.
In the unlikely event that we have to cancel a booking prior to guests arrival, we will refund all monies paid at our discretion.
Our bank account details are provided on request. All payments made online through the Cottage Escapes website are processed via Sagepay safe gateway payment processing.
Website Details , Wifi and mobile phones
We have taken great care to ensure all information on our website is accurately describing and displaying correct imagery of the properties. Services and facilities are constantly being checked and improved at all our properties but occasionally some services or facilities might not be available or working correctly, in which case we will do our very best to make this information available to you as soon as we become aware of it.
we cannot accept any liability for changes or closures to any main services or local attractions etc, this is beyond our control.
Wifi is provided at all Thirley Cotes farm properties by Satellite broadband. This is a very rural location and service levels are not the same as a large town city, we have installed the best available service, but it is not suitable for gaming/streaming films etc , so we cannot guarantee unlimited and uninterrupted service.
Mobile phone signals vary by provider and signal strength on site can be poor for certain networks, although better signals can be achieved relatively close to the property. We offer no guarantees for quality of either mobile reception of Wifi in this area.
We publish our prices on our website, we charge a weekly price and a % thereof for short breaks depending on the length of stay. Bookings made on Yorkshire cottages direct with Cottage Escapes do not have any additional booking fees, Pets are charged at £15 each per booking and a supplement of £10 per night is charged for using the sofa beds in Oak and Willow cottage. We reduce our weekly prices by 15% if booking within three weeks of departure and similarly any short break price within seven days of departure. We aim to provide excellent accommodation and facilities to our guests for a fair value.
Arrivals and Departure
Our guests are kindly requested to arrive no earlier than 3pm and to depart no later than 10am, to ensure we have sufficient time to prepare the cottages for new guest arrivals. When you arrive, please ensure you read the property information folder to help you with everything you need to know for a safe and enjoyable holiday. We have a local office on site at Thirley Cotes farm and will be very pleased to help you with anything you need during your stay with us.
We do not operate changeovers on Sundays.
Gardens and Parking & facilities
There is plenty of outside parking for cars and three bays for covered parking on a first come first served basis. The cottages share a main lawned area and have access to a large adjacent field for games etc, we have a small children’s play area for under 12’s. In addition, we have a 10 acre field in front of the farm usually occupied by many sheep and lambs at the right time of year, finally there’s a 4 acre woodland to explore and spot the local wildlife. There is a water course running alongside the southern boundary of the entire property including the woodland and young children must be supervised and not allowed to play near those areas on their own.
There is a small games room for use by residential guests only, children under 12 must be supervised accordingly.
Guests are requested not to smoke in any of the cottages nor on the grounds.
All our cottages accept pets except Holly cottage. the larger cottages, Sycamore and Thirley Cotes Farmhouse accept two pets otherwise, one pet at the other cottages. Being in the countryside with livestock, sheep and lambs nearby, is it essential that owners abide by the ‘rural rules’ when taking their pets on holiday. All pets must be kept on their leads and please clean up any mess made. The following rules must be followed in the cottages:
Please keep pets off the furniture and out of the bedrooms.
Please exercise your pets safely and clean up after them.
Please remove any pet hairs before you leave.
Please let us know at the time of booking the breed of pet
Certain breeds are subject to our approval.
Security deposits, Damages and Unreasonable Behaviour
We levy a refundable £150 security deposit for Sycamore Cottage and Thirley Cotes Farmhouse. This will be shown on your booking confirmation and is refunded within 14 days of departure ( less any costs for breakages, damages etc ) .
For any booking on any of our cottages, we have the right to recover costs incurred for any damage caused by you or members of your party or visitors. We expect the property to be left in a reasonable state after your departure, you will be liable for any additional cleaning costs incurred.
We can refuse access to our properties if we have reasonable cause to believe that your behaviour is unreasonable and likely to cause offence to us or other guests or members of staff, if this happens, the contract with us ceases and no monies will be refunded nor will we have any legal liability to you. We can also request that you leave the property anytime after you have received the keys on arrival if again we have reasonable cause to believe the above behaviour exists whilst staying at the property.
We do not accept bookings for Hen or Stag parties , our cottages cater for couples of families enjoying the peace and tranquillity of the location and we kindly request that all guests respect other guests whilst enjoying their stay with us .
We provide a ‘shared’ hot tub facility on site. This is only available for people over the age of 16 between 11am and 10pm, please read the guidance for use in the information folder.
Power, Fuel, Bed linen and Towels
There is no charge for using electricity, gas or water. An initial supply of logs is provided in Thirley Cotes Farmhouse, then it’s readily available locally.
We provide all bed linen ( except for cots ) free of charge and also towels.
Cots, Highchairs and Stairgates.
We provide one travel cot and highchair per property and Stairgates where relevant. We do not provide the bedding for cots.
Disabilities and medical problems
If you or any member of your party has any problem that might affect your booking, we must be informed before you make the booking and provide full details in writing before you travel. If we feel legitimately unable to meet your needs, we can refuse the booking.
You must let us know at the time of booking any special requests you might have and confirm them in writing, we will of course try to meet your requests provided they are entirely reasonable, but failure to do so will not mean our contract is broken with you.
Cancellations or changes to bookings
We require a minimum of six weeks before your holiday start date to consider any request to change your booking. This may be accepted verbally, but should be either in writing by post or by email to email@example.com. We may levy a £25 + vat charge depending on the change to be made and if you are moving to different dates, the rates prevailing for those dates will apply which could be more or less than your original booking. In either case we would refund/charge the difference so the correct rate is finally charged.
We recommend you have the necessary UK travel insurance cover in place, we do not provide this.
if you need to cancel your booking in full, any deposit paid for the holiday will not be refunded and if the full monies have been paid at the time of cancellation, we will refund monies subject to a cancellation charge as follows :
number of days before the start of your holiday we receive your notice to cancel :
more than 56 days : cancellation charge is the full deposit paid
29 to 56 days : cancellation charge is 40% of full accommodation cost or monies paid, whichever is greater
15 to 28 days : cancellation charge is 70% of full accommodation cost
8 to 14 days : cancellation charge is 90% of full accommodation cost
7 days or less : cancellation charge is the full accommodation cost.
We will endeavour to re-let your holiday dates in the event of cancellation and we will refund all monies to you if we do this successfully, subject to an admin charge of £50 + vat . Should the final monies paid for the original holiday be lower ( perhaps as a result of a late bargain discount ), then only the reduced price would be refundable .
If for any reason you have to cut short your stay, we cannot refund any monies paid, unless as above we manage to re-let the unexpired portion of your stay. The same charges apply and refund policy applies.
Cancellations by us
We do not expect to have to cancel or change any confirmed booking made with Cottage Escapes, if this occurs, we will contact you immediately to explain the circumstances arising and if necessary refund all monies paid but will have no further liability to you.
it is essential that you put any queries or concerns to us immediately, so we can have the opportunity to resolve matters for you. We have an office onsite at Thirley Cotes Farm with competent staff who can sort most issues for you subject to events beyond our control, we will endeavour to resolve matters.
Events beyond our control
We cannot be held legally responsible for any compensation if we cannot carry out our responsibilities to you under our contract as a result of events beyond our control. This is an event that we could not avoid including:
Natural disaster, Acts of terrorism, Malicious damage, Accident, Breakdown of equipment or machinery, Fire, flood, snow or storm, war, riot or civil commotion.
Governing Law & Jurisdiction
Any dispute, claim or other matter which may arise in relation to your booking with us will be governed by English law and you agree the dispute would be handled by the courts of England and Wales.
Newsletter and data
Any data collected during the course of a booking may be kept on a computer for our own use and will not be divulged to a third party. Your email may be added to our private cottage newsletter and, until you notify us using the unsubscribe option at the end of the newsletter email, you will receive these communications. Any prospective customer, making any enquiry to Cottage Escapes may also be added to this cottage newsletter list and, unless we receive the unsubscribe notification, will receive our newsletter.
Communicating with you
We would like to communicate by various means with you about offers or news we have from time to time, please let us know when booking if you do not wish to receive any information from us.
Our pricing can change anytime whilst marketing our properties and new rates supersede all old ones at the time they’re published.
